These Terms of Service govern your access to and use of builtinthefirebrand.com⁠, including all purchases, memberships, bookings, coaching services, digital products, and other services offered by Built in the Fire.

By visiting the website, submitting information, creating an account, booking a service, joining a membership, or purchasing a product, you agree to these Terms.

1. Business Information

The website is operated by Christopher Cuadra, doing business as Built in the Fire, in California, United States.

The terms “BITF,” “Built in the Fire,” “we,” “our,” and “us” refer to the website operator. “Customer,” “client,” “member,” “user,” “you,” and “your” refer to anyone using the website or purchasing our products or services.

2. Eligibility

You must be at least 18 years old to purchase coaching, memberships, or other age-restricted services.

Customers under 18 may purchase physical products only with the permission and supervision of a parent or legal guardian.

You agree to provide accurate, current, and complete information when placing an order, creating an account, completing a form, or booking a service.

3. Products and Services

Built in the Fire may offer:

  • Apparel, activewear, performance wear, sports gear, and accessories
  • Made-to-order and print-on-demand products
  • Digital guides, programs, training materials, and downloadable content
  • Fitness coaching, transformation programs, consultations, and advisory services
  • Recurring memberships and community benefits
  • Promotional collaborations and third-party business features

Product availability, colors, sizing, pricing, services, program contents, and benefits may change without notice.

4. Made-to-Order and Print-on-Demand Products

Certain products are created only after an order is submitted. Minor differences in color, print placement, garment measurements, texture, or appearance may occur because of manufacturing methods, monitor settings, and product updates.

These reasonable production differences are not automatically considered defects.

Customers are responsible for reviewing product descriptions and size guides before ordering.

5. Orders and Payment

All prices are displayed in U.S. dollars unless otherwise stated.

You agree to provide valid billing, shipping, and payment information. We may refuse, limit, cancel, or refund an order when we reasonably suspect:

  • Fraud or unauthorized payment
  • Incorrect pricing or product information
  • Resale activity that was not approved
  • Abuse of discounts or promotions
  • Violation of these Terms
  • Product unavailability

An order confirmation does not guarantee acceptance. An order becomes accepted when payment is approved and fulfillment begins.

Applicable taxes and shipping charges are calculated during checkout.

6. Shipping

Built in the Fire currently offers:

  • $10 standard shipping on qualifying U.S. orders under $100
  • Free standard shipping on qualifying U.S. orders of $100 or more
  • Worldwide shipping when available for the selected product and destination

Delivery estimates are estimates and are not guaranteed. Delays may occur because of production, carrier operations, weather, holidays, customs, address errors, or circumstances outside our reasonable control.

International customers are responsible for applicable customs charges, import duties, taxes, and fees imposed by their country.

Customers must provide a complete and accurate shipping address. Built in the Fire is not responsible for orders delivered to an address incorrectly entered by the customer.

7. Returns and Refunds

Eligible physical products may be returned within 30 days of delivery, subject to the published Return and Refund Policy.

To qualify, an item must generally be:

  • Unworn and unused
  • Unwashed
  • Free of stains, odors, hair, damage, or alterations
  • Returned with its original packaging or tags when applicable
  • Accompanied by proof of purchase

Final-sale merchandise, personalized products, custom products, gift cards, and certain made-to-order products may be non-returnable unless damaged, defective, or incorrectly fulfilled.

Original shipping charges are generally non-refundable. Customers may be responsible for return shipping unless the product arrived damaged, defective, or incorrect.

Refunds are issued to the original payment method after the returned item is received and approved.

8. Digital Products

Digital downloads, guides, programs, templates, customized plans, and other electronic materials are generally non-refundable once delivered, downloaded, accessed, or emailed.

Customers receive a limited, personal, non-transferable license to use purchased digital products for their own lawful, noncommercial purposes.

Customers may not copy, resell, redistribute, upload, publish, share, sublicense, or commercially exploit digital materials without written authorization.

9. Coaching and Appointments

Appointments must be scheduled through the official booking system on the website.

Clients are responsible for providing accurate contact information and attending at the scheduled time. Unless otherwise stated in the specific service policy:

  • Missed appointments and no-shows are non-refundable.
  • Coaching calls are non-refundable once delivered.
  • Customized training, nutrition, or development plans are non-refundable once prepared or delivered.
  • Rescheduling and cancellation requests must follow the policy displayed during booking.

Purchasing coaching does not guarantee a particular physical, personal, professional, or financial result.

10. Fitness and Health Disclaimer

Built in the Fire provides general fitness, discipline, motivation, and educational information. It does not provide medical diagnosis, medical treatment, physical therapy, mental-health treatment, or emergency services.

You should consult a qualified healthcare professional before beginning a workout, nutrition, supplement, or lifestyle program—particularly if you have an injury, medical condition, disability, take medication, or have not exercised regularly.

You voluntarily assume the ordinary risks associated with exercise and physical activity. Stop exercising and seek appropriate medical assistance if you experience pain, dizziness, difficulty breathing, or other concerning symptoms.

Customer testimonials represent individual experiences and do not guarantee that another customer will obtain the same result.

11. Memberships and Automatic Renewal

Paid memberships automatically renew at the frequency and price disclosed during enrollment unless canceled before the next renewal date.

Before enrollment, the checkout or membership page will disclose the recurring price, billing frequency, material conditions, and cancellation method.

Customers may cancel through their account when available or by contacting builtinthefire.coaching@gmail.com.

Canceling prevents future renewals but does not ordinarily create a refund for a billing period that has already started, except where required by law.

12. Promotions and Discount Codes

Promotions are subject to their stated dates, eligibility requirements, exclusions, and availability.

Discounts:

  • Have no cash value
  • Cannot be duplicated, transferred, or resold
  • Cannot be combined unless expressly permitted
  • May be canceled in cases of fraud, error, or abuse
  • Cannot normally be applied retroactively

13. Reviews, Testimonials, and User Content

If you submit a review, photograph, video, testimonial, comment, tag, or other content, you represent that it is truthful and that you have the right to submit it.

You grant Built in the Fire a nonexclusive, royalty-free license to display, reproduce, and share submitted content for operating and promoting the brand, subject to applicable law.

Built in the Fire will not purchase, create, suppress, manipulate, or misrepresent reviews in a manner intended to deceive customers. Paid, gifted, affiliate, employee, or other material relationships should be clearly disclosed. These provisions reflect current FTC endorsement and testimonial guidance⁠.

14. Third-Party Products and Promotions

The website may feature independent creators, businesses, sponsors, partners, payment processors, fulfillment providers, or external websites.

Unless expressly stated otherwise, third-party businesses are responsible for their own:

  • Products and services
  • Payments and order fulfillment
  • Shipping and pickup
  • Returns and refunds
  • Customer service
  • Representations and conduct

Built in the Fire is not responsible for an independent third party’s actions, website, availability, or policies.

15. Intellectual Property

The Built in the Fire name, BITF name, logos, slogans, graphics, product artwork, photographs, videos, written content, digital programs, and website design are protected intellectual property.

You may not use, reproduce, modify, manufacture, distribute, sell, imitate, scrape, or commercially exploit this material without prior written authorization.

Purchasing a product does not transfer ownership of the underlying logo, artwork, trademark, copyright, or design.

16. Prohibited Conduct

You may not use the website to:

  • Violate any law or third-party right
  • Commit fraud or submit unauthorized payment information
  • Introduce malware or interfere with website security
  • Scrape, harvest, or misuse customer or website data
  • Impersonate another person
  • Harass customers, staff, coaches, or partners
  • Copy or resell protected materials
  • Submit false reviews, claims, or chargebacks
  • Circumvent purchasing limits or website protections

We may suspend access, cancel orders, or terminate accounts for violations.

17. Disclaimer of Warranties

To the fullest extent permitted by law, the website, content, products, and services are provided “as is” and “as available.”

We do not guarantee uninterrupted website access, error-free content, continuous product availability, specific fitness results, business results, personal transformation, or compatibility with every device or individual.

Nothing in these Terms excludes warranties or consumer rights that cannot lawfully be excluded.

18. Limitation of Liability

To the fullest extent permitted by law, Built in the Fire and Christopher Cuadra will not be responsible for indirect, incidental, special, punitive, or consequential losses arising from the website, products, services, coaching, digital content, shipping delays, or third-party services.

When liability cannot legally be excluded, total liability will not exceed the amount the customer paid for the specific product or service giving rise to the claim.

This limitation does not apply where prohibited by law.

19. Indemnification

You agree to defend and indemnify Built in the Fire and Christopher Cuadra against third-party claims, losses, liabilities, and reasonable expenses arising from your unlawful use of the website, violation of these Terms, infringement of another party’s rights, or misuse of purchased content.

20. Governing Law

These Terms are governed by the laws of the State of California and applicable federal law, without regard to conflict-of-law principles.

Before filing a claim, you agree to contact builtinthefire.coaching@gmail.com and make a reasonable good-faith effort to resolve the matter informally.

21. Changes to These Terms

Built in the Fire may revise these Terms when its products, services, operations, or legal obligations change.

The updated Terms will be posted on the website with a revised effective date. Continued use of the website after an update constitutes acceptance of the revised Terms.
